El Parlamento israelí aprobó este lunes de forma definitiva la ley que anula la doctrina de la razonabilidad, la primera ley del paquete legislativo de la polémica reforma judicial liderada por el Gobierno de Benjamin Netanyahu.
La ley salió adelante con 64 votos a favor -todos los diputados de los partidos de la coalición de gobierno- y cero en contra, ya que se ausentaron de la votación los 56 diputados del bloque opositor como forma de protesta.
En la votación del lunes, los legisladores aprobaron una medida que impide a los jueces anular decisiones del gobierno basándose en que son “irrazonables”. La doctrina de la razonabilidad, ahora anulada, permitía al Tribunal Supremo revisar y revocar medidas o nombramientos gubernamentales y es vista por el movimiento de protestas como una garantía democrática fundamental frente a abusos de poder.
Sus defensores informaron que el actual criterio de “razonabilidad” otorga a los jueces no elegidos excesivos poderes sobre la toma de decisiones por parte de los funcionarios elegidos. Pero sus detractores afirman que elimina un elemento clave de los poderes de supervisión del tribunal y abre el camino a la corrupción y a los nombramientos indebidos.
