República Dominicana. – Los padres pueden excluir de la herencia a los hijos que incurran en maltrato físico o emocional en su contra, aseguró la Suprema Corte de Justicia, según un comunicado del Poder Judicial divulgado este lunes.
De esa forma se desprende de la decisión de la Primera Sala de la SCJ que rechazó el recurso de casación interpuesto contra una sentencia civil al respecto y que estableció que “la exclusión de la herencia por indignidad o desheredación constituye una sanción civil que conlleva la privación del derecho a la sucesión del sancionado”.
De ello se deriva que los hijos que “hubieren maltratado, injuriado gravemente con hechos o palabras a sus progenitores o que les hubieren negado su protección o asistencia pueden ser declarados indignos para recibir la sucesión de sus causantes”, como se desprende del artículo 727 del Código Civil.
También, la postura es conforme a la Constitución dominicana que, en su artículo 57, establece la protección de la persona envejeciente como parte integral de los derechos fundamentales.
