Los cargos de asesinato por aborto autoinducido contra Lizelle Herrera, que permaneció durante tres días bajo arresto en la cárcel, serán retirados, anunció ayer el fiscal de distrito del condado texano de Starr, en EE.UU., Gocha Allen Ramírez.
«Al revisar la ley aplicable de Texas, está claro que la Sra. Herrera no puede ni debe ser procesada por la acusación en su contra», indicó en un comunicado Ramírez.
Asimismo, agregó que la investigación criminal y la acusación de asesinato se dieron después de que un hospital notificara al Departamento del Alguacil del condado de Starr sobre el aborto, que fue realizado el pasado mes de enero.
«La Sra. Herrera no cometió un acto delictivo según las leyes del estado de Texas», señaló el fiscal, concluyendo que esta «no enfrentará un proceso judicial por este incidente».
Aún no está claro bajo qué estatuto de la ley estatal antiaborto de Texas se acusó a Herrera, ya que se han hecho públicos pocos detalles del caso. Tampoco se sabe exactamente cómo se realizó el aborto y qué tan avanzado había sido el embarazo.
