El presidente Generación de Servidores (GS), Carlos Peña, informó este martes que la entrada en vigencia de la resolución 00-48 del Ministerio de Salud Pública que exige la presentación de tarjetas de vacunación en lugares públicos y privados es “inconstitucional” y calificó como ” una alocada forma de vivir” los contratiempos que vivieron los ciudadanos. Sostuvo que esa medida constituye un nuevo estado de emergencia para la población.
“Esperamos que la justicia dominicana le quite esta presión a la población dominicana que se le ha impreso con esta resolución del Ministerio de Salud Pública que es totalmente inconstitucional”, dijo Peña.
Sostuvo que con esta disposición una gran cantidad de ciudadanos no pudo llevar a sus hijos a las escuelas, cumplir pagos en servicios de tarifa eléctrica, asistencia de audiencias.
Manifestó que tras presentar un recurso contencioso administrativo ante el Tribunal Superior Administrativo (TSA) espera la suspensión definitiva de la medida del Ministerio de Salud Pública que calificó de “ilegal e ilegítima”.
Peña ofreció estas declaraciones previo al conocimiento del recurso contencioso administrativo en el Tribunal Superior Administrativo (TSA).
Precisó que con esta medida se conculca los derechos fundamentales de los ciudadanos y que “esta no es una lucha entre vacunado y no vacunados” y que se discrimina y divide a los ciudadanos en clase A y B.
Dijo que si se permite imponer esas medidas hay que prepararse para que el Estado decida que se puede hablar, con quien se puede reunir e insistió en que el Estado no puede rebasar la dignidad humana.
De su lado, el abogado Demetrio Sánchez calificó como “enferma” resolución de las autoridades puesto que por el orden piramidal la Constitución está por encima de cualquier decreto.
Asímismo, recordó que el Ministro de Turismo, David Collado, emitió un comunicado donde no se le exige tarjeta de vacunación y pruebas PCR a los turistas por lo que no se puede dar ese tipo de privilegios en detrimento de los dominicanos.
Por otro lado, el jurista Yan Carlos Martínez Segura realizó un llamado al presidente Luis Abinader a que reconsidere esa resolución ya que afecta las decisiones individuales de los ciudadanos y que contraproducentemente la medida que busca proteger la salud viola el derecho a la salud debido a que muchos pacientes no ingresaron a centros médicos por no tener la tarjeta de vacunación.
